Terms of Appointment

The Chair is appointed by the Secretary of State for the Environment. A draft of the full terms and conditions is available on request, but the key points are summarised below.

Period of appointment

The appointment is for three years, with the possibility of one re-appointment, subject to satisfactory performance and attendance.

The appointee may resign at any time by notice in writing to the Ministers. The Ministers may terminate the appointment under certain conditions, which will be notified to the successful candidate on appointment.

Remuneration

The fee for the Chair is £40,459.77 per annum for a time commitment of 8 days per month (£110,000 pro rata)
Reasonable travel and other expenses will be reimbursed.

Conduct

The Chair must observe the highest standards of impartiality, integrity and objectivity in relation to stewardship of public funds and management of the MMO. Appointees will be accountable to the Secretary of State for the Environment and should not use information gained in the course of this appointment for personal gain or to promote other interests. Any appointment can be terminated early by the Secretary of State if the appointee fails to perform his or her duties to a satisfactory standard.

You must declare any personal or business interests which may, or may be perceived to, influence your judgements in performing your functions. Should a particular matter give rise to a conflict of interest, you would be required to inform the Board in advance and withdraw from discussions or consideration of the matter.

You are not expected to occupy paid party political posts or hold particularly sensitive or high roles in a political party. Subject to the foregoing, you are free to engage in political activities provided that you are conscious of your general public responsibilities and exercise a proper discretion, particularly with regard to the work of the MMO. Your appointment may be terminated if you accept a prominent position in any political party if the Secretary of State feels the positions are incompatible.

The MMO Board will meet at least 4 times per year. These meetings will either be at the HQ in Newcastle, in London or at one of the MMO regional offices around the coast.

Thank you for your interest in the role of Chair of the Marine Management Organisation (MMO).

The MMO is a young organisation, successfully vested on 1 April 2010. It was established to make a significant contribution to sustainable development in the marine area and to promote the UK Government’s vision for clean, healthy, safe, productive and biologically diverse oceans and seas.

It is a body which has been warmly welcomed by stakeholders across the whole marine area. It brings together the roles and interests of a number of Departments in a modern example of joined-up Government.
Although the organisation is still growing and developing, it has had a number of key successes in the early months, including the announcement of the first two marine plan areas.

Looking to the future, the MMO takes on wider responsibilities for marine planning and will launch a streamlined licensing system on 1 April 2011. These new areas will help transform delivery. I am also looking to the MMO to forge strong, collaborative relations with the Inshore Fisheries Conservation authorities which will be vested on 1 April 2011. The MMO is also uniquely placed to help deliver better local engagement and a stronger civil society. Clearly too there will be challenges as the MMO, like all public bodies, delivers more with less.

The most important qualities I am looking for from the Chair of the MMO are: leadership, judgement and the ability to work across a complex stakeholder landscape. Because the environment in which the MMO operates is so diverse, it is more important that you can inspire confidence across a wide range of stakeholders than that you have a strong history in any one marine or maritime sector.

The MMO is vital to Defra’s aim to help people take more responsibility for their environment, and encourage sustainable behaviour. There are many challenges ahead, but meeting those challenges will be interesting and rewarding, bringing the satisfaction of uniting disparate interests in a common aim – safeguarding our marine area for generations to come.

About the MMO

The MMO is an executive non-departmental public body (NDPB) established and given powers under the Marine and Coastal Access Act 2009. This pioneering Act brought together for the first time key marine decision-making powers and delivery mechanisms.

The MMO has incorporated the work of the Marine and Fisheries Agency (MFA) and acquired several important new roles from the Department of Energy and Climate Change (DECC) and the Department for Transport (DfT). It is also taking on some entirely new and cutting edge functions, most notably marine planning.

The establishment of the MMO as a cross-government delivery partner therefore marks a fundamental shift in planning, regulating and licensing activity in the marine area with the emphasis on sustainable development.
The MMO has a wide range of responsibilities, including:
A number of Governments Departments have a strong interest in the work of the MMO and it is therefore sponsored jointly by the Department for Environment, Food and Rural Affairs (Defra), DECC, DfT, Communities and Local Government (CLG) and the Ministry of Defence (MoD). The Secretary of State for Environment, Food and Rural Affairs is accountable to Parliament for the MMO, a responsibility she exercises on behalf of the other sponsoring Departments.

The MMO has approximately 240 staff. Its headquarters are in Newcastle Upon Tyne and it has 18 coastal offices.

Job Description

The Marine and Coastal Access Bill, currently being considered by Parliament, seeks to establish the Marine Management Organisation (MMO): a new independent Non Departmental Public Body, as the UK Government's strategic delivery body in the marine area and its centre of marine management expertise. This will ensure effective planning and management of our seas.

The Government's vision for the MMO is that it will be a professional and proactive marine manager, trusted by all stakeholders to make a significant contribution to the sustainable development in the marine area. It will make decisions on the majority of marine developments and, where it is not the decision making body, will be a key advisor on marine issues.

The MMO will be the marine planning authority on behalf of the UK Government and its principal regulator in English territorial waters and the UK offshore area for matters that are not devolved. It will deliver functions on behalf of several Government Departments. As the Government's key marine regulator, the MMO will have an important role in contributing to the Government's objectives for nature conservation.

In addition to its new responsibilities, the MMO will take on the functions currently delivered by the Marine and Fisheries Agency (MFA) (an Executive Agency of the Department for Environment, Food and Rural Affairs). These include marine and fisheries enforcement, licensing and management of fishing activity under the European Common Fisheries Policy, licensing of marine activities and developments (such as wind farms, wave and tidal power, marine sand and gravel extraction) and contingency for pollution incidents. The Marine and Coastal Access Bill will provide the MMO with modernised enforcement powers and new streamlined marine licensing arrangements. It is envisaged that the MMO will come into operation on 1 April 2010 and on that date will subsume the MFA and its functions.

To facilitate preparations for the MMO, Chris Parry has been appointed as the Chair-designate of the MMO. He is working closely with the MFA to ensure that staff with the right skills are available in good time for launch of the MMO in April 2010. Recruitment for the Board of the MMO is due to start shortly.

The Chair and Board set the strategic direction of the MMO. The Chief Executive is responsible for developing and providing advice to the Board on the strategic direction and for leading the MMO in the delivery of the strategic aims.

The Chief Executive is responsible to the MMO Chair and Board for the day to day management and executive leadership and for the performance of the organisation.

Conditions for the appointment of the CEO/CEO designate for the MMO

(Note that there are particular conditions for existing public and civil servants)

Length of Appointment

The appointment term is fixed for three years with options to renew for a further year.

Salary

Up to £110,000

Bonus

A discretionary non-consolidated, non-pensionable performance bonus of up to a maximum of 15% of basic salary may be payable, subject to the achievement of agreed Corporate and Individual Performance objectives.

Pension

The post is pensionable.

The successful applicant will be able to choose between two pensions arrangements:You do not have to join the Civil Service Pension arrangements - you may opt out and be covered instead by a personal pension or the State Second Pension (S2P).

Location

The post is based in Newcastle. Some travel within the UK will be required.

Relocation package/expenses

There is no relocation package.

Leave

Paid annual leave of 30 days per year plus 10.5 public and privilege holidays

Expenses

The CEO will be reimbursed for all reasonable travel, accommodation and other expenses in accordance with the rules set out in the Staff Handbook (as amended from time to time), which are wholly, exclusively and necessarily incurred in relation to the performance of their duties and responsibilities.

Conditions for existing Civil/Public servants

Existing Civil Servants would have to resign from their current Civil Service post prior to taking up this post.

Pension arrangements for existing Civil/Public servants:

Following the establishment of the MMO, it is likely that the successful candidate would be eligible to rejoin the Civil Service Pension Scheme as the MMO has been accepted in principle into the Civil Service Pension Scheme. The pension guidance states:

For rejoiners who were in were in classic, classic plus, premium or nuvos and who join your organisation after a break of no more than 28 days in CSP employment, except those who left under:You will be covered by the Civil Service pension arrangements during this appointment. You will rejoin the pension scheme that you recently left.

We suggest candidates speaks direct to their pension administrator in order to satisfy themselves about the effects on his pension.
